1. About these Terms

These Terms are an agreement between you and Canadian Global Consultants LLC, a Wyoming limited liability company doing business as Going Pro Yoga (“Going Pro Yoga,” “we,” “us”). They govern your use of goingproyoga.com and everything we provide through it (the “Service”).

By creating an account, starting a free trial, or purchasing a subscription, you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy forms part of these Terms.

2. Eligibility and your account

You must be at least 18 to buy a subscription. The Service is not intended for children under 13, and we do not knowingly collect their information.

You are responsible for the accuracy of your account details, for keeping your password secure, and for everything that happens under your account.

Your account is personal to you. Sharing your login, or allowing anyone else to access the Service through your account, is a material breach of these Terms and may result in suspension without refund.

3. What the membership includes

A subscription gives you access, for as long as it remains active, to the materials we publish in the members’ area — currently the SmartCue™ pose systems, the sequencing framework, our YACEP programs, the class and sequence library, and the Teacher’s Toolbox.

The Service is a living library. We add, update, retire and reorganise material over time, and the specific content available may change. We do not guarantee that any particular item will remain available for the life of your subscription.

Everything we provide is educational. It is not medical, physiotherapy, psychological, dietary or financial advice, and it does not create a practitioner–patient or professional–client relationship. See section 9.

4. Free trial, billing and automatic renewal

Read this section carefully — it explains when you are charged.

Free trial. New members may start a 7-day free trial. We collect your payment details when you sign up, but you are not charged during the trial. The trial is limited to one per person.

Automatic renewal. Unless you cancel before your trial ends, your subscription begins automatically and your payment method is charged. It then renews automatically each billing period until you cancel.

All prices are in US dollars and exclude any taxes that may apply where you live. Your bank may apply currency-conversion or foreign-transaction fees; those are outside our control.

Payment. Payments are processed by Stripe through SureCart. We do not store your full card details. By subscribing, you authorise us to charge your payment method for each renewal.

Failed payments. If a payment fails, we will retry it up to three times. We may suspend your access while payment is outstanding. If payment has not succeeded within 30 days, we may cancel your subscription and close your access. You can subscribe again at any time.

Price changes. We may change our prices. If a change affects your subscription we will give you at least 30 days’ notice by email, and it will take effect at your next renewal. If you don’t accept it, cancel before then.

5. Cancelling

You can cancel at any time, from your account area on our website, through our contact form, or by emailing info[at]goingproyoga[dot]com.

  • Cancel during the trial → you are never charged.
  • Cancel after that → your subscription stops at the end of the period you have already paid for. You keep access until then. We do not charge you again.

Cancelling stops future payments. It does not refund payments already taken — see section 6.

6. Refunds

The 7-day free trial is how you try the Service before paying anything. We encourage you to use it.

Because access to the full library is granted immediately, subscription payments are generally non-refundable, and cancelling part-way through a period does not produce a partial refund.

Two exceptions:

  • Where the law gives you a refund or withdrawal right, that right applies. Nothing in these Terms removes rights you have as a consumer, including under EU, UK or other applicable law.
  • We use discretion. If something has genuinely gone wrong — a duplicate charge, a renewal you plainly didn’t intend, a technical failure that stopped you using the Service — contact us through our contact form or at info[at]goingproyoga[dot]com and we’ll look at it.

7. Your licence to use the materials

This is the section that matters most to you as a teacher, so we’ve tried to make it plain.

While your subscription is active, we grant you a personal, non-exclusive, non-transferable, revocable licence to:

  • access and study everything in the members’ area; and
  • use the sequences, cues, methods and teaching material in classes, workshops and private sessions that you personally instruct — including classes you are paid for.

That second point is deliberate. This material exists to be taught. You do not need to credit us, though we always appreciate it.

What the licence does not permit:

  • reselling, redistributing, republishing or sharing the materials, in whole or in part, in any format
  • sharing your login, or giving anyone else access through your account
  • reproducing the materials — or a derivative that is substantially the same — as your own course, teacher training, certification, manual or product, whether paid or free
  • posting our videos, audio, PDFs or written sequences publicly, or uploading them to any other platform
  • using our name, logo or SmartCue™ branding to suggest we endorse, certify or are affiliated with you or your training, without our written permission
  • using the materials to build or train any machine-learning or AI system

In short: teach it freely, but don’t republish it, and don’t turn it into your own product.

This licence ends when your subscription ends. Sequences you have already taught are yours to keep teaching; continued access to the materials is not.

8. Acceptable use

You agree not to: attempt to access parts of the Service you have no right to; scrape, bulk-download, copy or mirror the Service; circumvent access controls, paywalls or download restrictions; interfere with the Service’s operation or security; or use the Service unlawfully.

9. Health, safety and assumption of risk

Please read this — it is the most important disclaimer here.

Yoga and physical movement carry an inherent risk of injury. This is true of practising yourself, and of teaching others.

By using the Service you acknowledge and accept that:

  • you take part at your own risk, and are responsible for your own health, physical condition and safety
  • you should consult a physician before beginning any new physical practice, particularly if you are pregnant, injured, recovering from surgery, or have any medical condition
  • you should stop immediately if you feel pain, dizziness or discomfort
  • our material is general education, not personalised assessment or treatment, and is not tailored to any individual’s body, injury or condition
  • Michael Henri Lalonde is a physiotherapist by training, but through the Service he is not acting as your physiotherapist, and no practitioner–patient relationship is created
  • when you teach others, you are solely responsible for their safety — for assessing whether a pose, cue or adjustment is appropriate for the student in front of you, for your own insurance, and for meeting the professional and legal standards that apply where you teach

Neither Going Pro Yoga nor Michael Henri Lalonde, Paul Teodo or Byron de Marsé is liable for injury to you or to anyone you teach.

10. Our intellectual property

All materials in the Service — text, video, audio, images, sequences, cueing systems, course structure, and the SmartCue™ name and branding — are owned by us or licensed to us, and are protected by copyright and other laws. Except for the licence in section 7, no rights are transferred to you.

11. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Service will be uninterrupted or error-free, or that it will produce any particular result. Outcomes depend on you — your practice, your teaching and your circumstances — and we make no guarantee about your results, your teaching career or your income.

12. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, lost opportunities or lost data.
  • Our total liability to you for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.

Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Going Pro Yoga, its members, officers, employees and contractors from claims, damages and reasonable legal costs arising from your breach of these Terms, your misuse of the Service, or your teaching of others — except to the extent caused by our own negligence or wilful misconduct.

14. Confidentiality

Where either of us shares information marked or reasonably understood to be confidential, the receiving party will keep it confidential and use it only for the purpose it was shared. This does not apply to information that is public, already known, independently developed, or required to be disclosed by law.

If you take part in any members’ community or group, respect other members’ privacy: don’t share their personal information or their contributions outside that space.

15. Suspension and termination

You may cancel at any time under section 5.

We may suspend or terminate your access if you breach these Terms — particularly by sharing your login, redistributing the materials, or misusing the Service — or if payment fails. Where it is reasonable to do so we will contact you first and give you a chance to put it right.

If we terminate your account for a breach, we are not required to refund amounts already paid. If we discontinue the Service entirely, we will refund the unused portion of any period you have paid for.

Sections 10 through 14, and 18, survive termination.

16. Changes to these Terms

We may update these Terms. If a change is material we will give reasonable notice by email or through the Service before it takes effect. Continuing to use the Service after that means you accept the updated Terms. Every version carries the effective date above.

17. General

Independent parties. Nothing here creates a partnership, joint venture, employment or agency relationship.

Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.

Severability. If a provision is unenforceable, the rest stays in force.

No waiver. Not enforcing a provision doesn’t waive it.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets.

Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.

18. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules.

Talk to us first. Most problems are solved by email. Before starting formal proceedings, contact us through our contact form or at info[at]goingproyoga[dot]com and give us 30 days to resolve it.

If we can’t, any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration may be conducted remotely or in Sheridan, Wyoming. Judgment on the award may be entered in any court of competent jurisdiction.

Either party may seek injunctive relief in court to protect intellectual property or confidential information. Either party may also bring a claim in small claims court if it qualifies.

Claims must be brought within one (1) year of when they arose, except where law requires longer.

If you are a consumer in the EU or UK, nothing in this section removes your right to bring proceedings in your local courts or to rely on your local consumer-protection law.
